My Kasambahay Woes and the Kasambahay Law

Masisiraan ata ako ng bait sa maid ko.

When you guys told me na ang swerte ko with Girlie and Jekjek, di ko masyado dinibdib. It's just now I realized how lucky I was before with those two. Hindi sila nagbigay masayado ng sakit ng ulo. All the kasambahay that I got after them, hay naku. Ang sakit sa bangs!

Lalo na this current one. Bigla na lang umiiyak. When I ask her why, wala daw. Ganun lang. She feels like crying every now and then. It's so weird. I asked kung pinilit lang ba siya lumuwas ng Maynila at magtrabaho, di naman daw. So really weird. And she doesn't talk ha? Tapos laging busangot yung fez. Yung tipong parang pasan niya buong universe. Ganun.

And when she has to do something, you have to instruct her in detail. For example, I was getting ready for work one morning. 

ME (raising one shoe): Paki lagay etong sapatos ko sa car.

Nakalabas na ako ng village when I noticed na yung isang shoe ko lang talaga yung nasa car. Yung isa, iniwan sa house.

There was also one time, Alvin asked the maid to buy something sa store. The sari-sari store was just there sa kanto namin. As in you just have to walk straight. Thirty minutes nawala ang maid. Pagbalik, walang dala. 

Di daw niya makita yung tindahan.

Ewan.

And today, I asked her to defrost the fridge. Our fridge has two doors. I opened the lower door when I was talking to her. Ayun sa awa ng Diyos, yung baba yung nadefrost pero yung freezer hindi.

And buti na lang I stayed home today. I was blogging at our living room when I noticed Missing In Action ang aking maid. Ang gulo gulo ng sala, master's bedroom and Anika's room. I looked for her and found her lying down sa bed nila. Mga ateng, 9am pa lang itey ng umaga. Wala na siyang ginagawa. I told her bakit hindi siya naglilinis ng bahay?! Dapat when Anika's in school, yun yung time ng linis niya sa buong bahay and sa rooms namin. 

Diyos ko talaga. Instead of makapagpahinga ako dito sa house because I'm sick, wala. Galaw pa din ako ng galaw because ang samok ng bahay. I need to find a replacement for her. Busangot na nga the whole day, ang bigat pa ng katawan magtrabaho.

Anyways, sorry to vent out like this. Nakiki-uso lang ako sa inyo.

The real reason why I'm blogging about kasambahays is the Kasambahay Law which took effect last June 4, 2013.. 

Okay na ba kayo dun? Gets niyo na? Ako kinda kaya now ko lang na-blog.

First, the minimum wage pala for a kasambahay in Metro Manila is Php 2,500. Before December 24 comes, the employers should give them their 13th month pay. And now, kailangan na din sila pa-sign and bigyan ng copy of their payslip. You can see a sample of the payslip here.

Second, the employer needs to pay for the SSS, Pag-ibig and the Philhealth of the kasambahay. 

•    For the SSS: If the kasambahay is earning below Php 5,000, the employer should shoulder the 10.4% of the gross salary for the SSS. If the salary of the kasambahay is 5k and above, the hatian is like this: Employer = 7.07% while the kasambahay = 3.33%

• Philhealth = Php 175 per month

• Pag-ibig = Php 100

Third, talking about the working hours:

•  The kasambahay needs to rest for a period of 8 hours per day. Aggregate yan meaning di kailangan continuous.

• The kasambahay needs to have a 24 hour consecutive day off per week. Pag-ayaw nila and magtatrabaho pa din sila, you have to pay them for that day. Or mag-off set na lang sa ibang araw ang rest day nila. Nakakaloka because my two maids do not want to go out every week. Magastos daw. Pagdi naman sila umalis, ako naman ang magagastusan. Kaloka.

• If the kasambahay had already served 12 months in a household, she is entitled to have a 5 day leave per year with pay.

Fourth, the normal rules na like the employer needs to give them food, shelter and medical assistance when needed.

Fifth, they need to have a contract. A contract na maiintindihan nila which malamang will be in Filipino. You can see a sample contract here.

O di ba? In general, that's the Kasambahay Law. Tama lang din naman for the protection ng mga namamasukan. Meron din kasi diyan na iba na masama magtrato ng maids eh.

Did you guys start na already the SSS contributions? And ano itong chismis na naririnig ko na naka-retro daw everything for all those kasambahays that are employed way before June 4, 2013? Totoo itech?

By the way, they also said that you have to register yourself as an employer sa SSS ha? Yan na ang hindi ko alam paano. I hope our respective baranggays will hold a free registration churva for the SSS, Pagibig and Philhealth.
